PLATFORM TERMS OF SERVICE

These Terms of Service (“Terms”) govern access to and use of app.wagerpaper.com and related application services (the “Platform”) operated by WagerPaper, LLC, a Wyoming limited liability company (“WagerPaper,” “Company,” “we,” “our,” or “us”).
By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.
1. No Gambling, Betting, or Prediction Market Services
WagerPaper does not:
• Offer or accept wagers
• Operate as a sportsbook or bookmaker
• Facilitate gambling transactions
• Operate a betting exchange
• Offer or trade prediction market contracts or event contracts
• Facilitate peer-to-peer wagering
• Provide betting advice
• Influence betting outcomes
The Platform provides digital memorabilia and authentication-related services only.
WagerPaper is not a gambling operator, sportsbook, betting exchange, prediction market, event contract marketplace, or financial trading platform. WagerPaper does not conduct, execute, clear, settle, or regulate gambling activity or event-based financial instruments of any kind.
2. Eligibility
You must be at least 21 years of age to use the Platform.
By using the Platform, you represent and warrant that:
• You are 21 years of age or older;
• Any referenced wager was lawfully placed in a jurisdiction where such wagering was legal at the time it was placed;
• You complied with all applicable laws and regulations in connection with any referenced wager;
• You have the legal right to upload and submit materials; and
• Submitted materials are authentic and unaltered.
WagerPaper does not independently verify the legality of any wager and disclaims responsibility for determining whether a user complied with applicable gambling laws.
WagerPaper may suspend or terminate accounts if eligibility requirements are not met.
3. Verification and Authentication
A “Verified” designation reflects WagerPaper’s internal review of submitted materials for consistency with user-provided information at the time of review.
Verification does not:
• Confirm legality of the wager;
• Confirm sportsbook compliance;
• Validate gambling licensing;
• Certify regulatory approval;
• Confirm identity beyond the account holder;
• Guarantee authenticity beyond submitted evidence; or
• Provide legal or regulatory certification of any kind.
If submitted materials are insufficient, inconsistent, altered, incomplete, unverifiable, or otherwise questionable in WagerPaper’s sole discretion, the issuance may be classified as Unverified.
WagerPaper reserves the right, in its sole discretion, to approve, deny, reclassify, suspend, or revoke verification status at any time and for any reason.
Verification decisions are final.
4. No Refund Policy
All issuance fees are final.
No refunds will be issued once processing begins, regardless of:
• Verification outcome;
• User error;
• Reclassification;
• Disputes with sportsbooks;
• Allegations concerning the underlying wager; or
• Subsequent account suspension.
5. Payments
Users agree to pay all applicable issuance fees.
Chargebacks, payment disputes, fraudulent transactions, or misuse of payment mechanisms may result in immediate account suspension or termination.
WagerPaper reserves the right to pursue recovery of improperly disputed or reversed payments.
6. No Investment or Financial Expectation
WagerPapers are digital memorabilia only.
They are not securities, financial instruments, investment contracts, speculative assets, or financial products.
WagerPaper makes no representation or warranty regarding resale value, appreciation, liquidity, market demand, or future economic benefit.
7. Data and Third-Party Information
Game data, scores, statistics, venues, and related information may be obtained from third-party sources.
WagerPaper does not guarantee the accuracy, completeness, or reliability of third-party data.
The Platform may rely on user-submitted materials and external data sources, and WagerPaper disclaims liability for inaccuracies in such materials.
8. Limitation of Liability
To the fullest extent permitted by law, WagerPaper’s total liability arising out of or related to these Terms or the Platform shall not exceed the amount paid by the user for the specific issuance giving rise to the claim.
WagerPaper shall not be liable for:
• Betting losses;
• Sportsbook disputes;
• Regulatory actions;
• Gambling compliance issues;
• Fraudulent or altered user submissions;
• Data inaccuracies;
• Account suspensions; or
• Indirect, direct, incidental, consequential, loss profits, special, or punitive damages
9. Disclaimer of Warranties
The Platform is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, WagerPaper disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, any and all defects, and accuracy.
WagerPaper does not warrant that the Platform will be uninterrupted, error-free, secure, or free of harmful components.
10. Account Suspension and Termination
WagerPaper may suspend or terminate accounts at its sole discretion for reasons including, but not limited to:
• Fraud;
• Misrepresentation;
• Altered or fabricated submissions;
• Chargebacks or payment disputes;
• Violation of these Terms; or
• Abuse of the verification process.
WagerPaper’s decisions regarding suspension or termination are final.
11. Indemnification
You agree to indemnify, defend, and hold harmless WagerPaper, LLC from and against any claims, damages, losses, liabilities, costs, or expenses arising out of:
• Your submissions;
• Your violation of these Terms;
• Your violation of applicable laws;
• Disputes related to underlying wagers; or
• Claims arising from user-generated content.
12. Dispute Resolution; Binding Arbitration; Class Action Waiver
A. Agreement to Arbitrate
You and WagerPaper agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or any relationship between you and WagerPaper shall be resolved exclusively through final and binding arbitration, rather than in court, except as otherwise provided herein.
This agreement to arbitrate includes, without limitation, disputes relating to:
Verification decisions;
Account suspension or termination;
Payment disputes or chargebacks;
Alleged misrepresentations;
User submissions;
Privacy claims;
Statutory or regulatory claims; or
Any claims asserted by You.
This arbitration agreement shall be governed by the Federal Arbitration Act (FAA).
B. Informal Resolution Requirement
Before initiating arbitration, you shall first contact WagerPaper in writing at the address listed in these Terms and attempt to resolve the dispute informally for at least thirty (30) days. This requirement to contact WagerPaper to for an informal resolution is a condition precedent to initiating arbitration.
C. Arbitration Procedure
Binding Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, applying both State and Federal law applicable for the State of Wyoming.
Arbitration shall be conducted by a single arbitrator.
Arbitration shall take place in Illinois, unless the parties agree otherwise, in writing.
The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement.
Judgment on the arbitration award may be entered in any court of competent jurisdiction.
D. Class Action Waiver
You hereby waive, with respect to any dispute or claim: I) the right to participate in a class action, private attorney general action or other representative action in Court or in Arbitration, either as a claim representative or class member; and ii) the right to join or consolidated claims with claims of any other person.
The arbitrator may not consolidate more than one person’s claims or preside over any form of representative or class proceeding.
E. Waiver of Jury Trial
To the fullest extent permitted by law, you and WagerPaper waive any right to a jury trial in connection with any dispute.
F. Exceptions
Nothing in this section shall prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction for claims relating to intellectual property infringement or unauthorized use of the Platform.
G. Severability
If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain in full force and effect, except that if the class action waiver is found unenforceable, the arbitration agreement shall be void.
13. Limitation on Time to File Claims
To the fullest extent permitted by applicable law, any claim or cause of action arising out of or relating to these Terms, the Platform, or any relationship between you and WagerPaper must be filed within one (1) year after the date You began submitting the information to the Platform for Verification in which the claim or cause of action arose, or it shall be permanently barred.
This limitation applies regardless of the form of action, whether in contract, tort, statute, or otherwise.
14. Modifications
WagerPaper reserves the right to modify or update these Terms at any time in its sole discretion.
Updated Terms will be effective upon posting to the Platform with a revised Effective Date.
Continued use of the Platform after any modification constitutes acceptance of the updated Terms.
15. Severability; Survival
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
Any provision that by its nature should survive termination of these Terms shall survive, including but not limited to provisions relating to:
• Verification decisions;
• Fees and payment obligations;
• No refund policy;
• Intellectual property rights;
• Limitation of liability;
• Indemnification;
• Arbitration and dispute resolution; or
• Limitation on time to file claims.
Termination of your account or access to the Platform shall not affect any rights or obligations that accrued prior to termination.
16. Entire Agreement
These Terms constitute the entire agreement between you and WagerPaper regarding the Platform and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral, relating to the subject matter herein.
